EQUIPMENT RENTAL AGREEMENT

1. Parties

Lessee:
Any natural or legal person (hereinafter referred to as the Client) who accepts this Agreement by booking, paying for, or using the rental equipment.
2. Nature of the Agreement
2.1. This Agreement constitutes a public offer within the meaning of Estonian law.
2.2. The Agreement is deemed accepted by the Client at the moment of booking, payment, or physical pickup of the equipment.
2.3. No handwritten or digital signature is required for this Agreement to be legally binding.
3. Subject of the Agreement
3.1. The Lessor provides the Client with temporary use of photo and/or video equipment specified in the rental order.
3.2. Equipment includes all items and accessories supplied together with the main equipment, including but not limited to cables, batteries, chargers, cases, and mounting elements.
4. Rental Period and Working Hours
4.1. The rental period is agreed individually for each order in writing, by e-mail, phone, or messenger.
4.2. One rental day is calculated as a 24-hour period, unless expressly agreed otherwise.
4.3. Standard handover and return hours are Monday to Friday from 10:00 to 18:00.
4.4. Pickup or return outside of standard working hours is possible only by prior agreement with the Lessor.
4.5. Friday rental and return
As a general rule, equipment rented on a Friday is returned on the next working day during standard working hours.
If the rental starts on a Friday and the equipment is returned on the following Monday no later than 10:00, the rental is considered one rental day, unless otherwise agreed in advance.
If the equipment is returned after 10:00 on Monday, the rental is considered two rental days.
If required due to operational needs or upcoming bookings, the Lessor may request the equipment to be returned during the weekend.
4.6. By prior agreement with the Lessor, the Client may:
– pick up the equipment outside of standard working hours;
– pick up the equipment on the evening before the booking day;
– return the equipment on the morning following the booking day.
Pickup and return outside of standard working hours do not affect rental day calculation unless expressly agreed otherwise.
5. Rental Price and Payment
5.1. Daily rental rates and the total rental amount are agreed before equipment handover.
5.2. Payment must be made before the equipment is handed over, unless otherwise agreed.
5.3. The Lessor reserves the right to refuse handover of the equipment until full payment is received.
6. Late Return
6.1. Failure to return the equipment at the agreed time without prior approval constitutes a late return.
6.2. Each started delay period is charged as one additional rental day.
6.3. If late return causes additional loss or prevents another booking, the Lessor reserves the right to claim additional compensation.
7. Client Responsibilities
7.1. The Client bears full financial responsibility for the equipment and all its components from the moment of handover until confirmed return.
7.2. Any loss, damage, theft, or missing items must be compensated at full replacement value or repair cost.
7.3. The equipment may only be used for its intended purpose and under normal operating conditions.
7.4. Subleasing, lending, or transferring the equipment to third parties without prior written consent of the Lessor is prohibited.
8. Handover and Return
8.1. Equipment handover and return may be documented by photo and/or video.
8.2. The Client must present a valid ID card or passport upon pickup.
8.3. Equipment must be returned complete, clean, and in the same condition as received, taking into account normal wear and tear.
8.4. The Client must immediately inform the Lessor of any damage, malfunction, or delay.
9. Personal Data
9.1. The Client consents to the processing of personal data (name, contact details, ID information) solely for the purpose of providing rental services.
9.2. Identification data is not stored longer than necessary for verification and legal purposes.
10. Force Majeure
10.1. The Parties are released from liability for failure or delay in performance caused by circumstances beyond their reasonable control.
10.2. Such circumstances include, but are not limited to, natural disasters, fire, war, strikes, government actions, power outages, and major technical failures.
11. Consumer Protection
11.1. If the Client is a natural person acting as a consumer, all mandatory rights under Estonian consumer protection law apply.
11.2. Nothing in this Agreement limits statutory consumer rights.
12. Final Provisions
12.1. This Agreement is governed by the laws of the Republic of Estonia.
12.2. Any disputes shall be resolved in Harju County Court (Harju Maakohus), unless otherwise required by law.
12.3. The Lessor reserves the right to refuse rental without providing a reason.
12.4. The current version of this Agreement is published electronically and applies to all rentals unless replaced by a newer version.
