These Terms and Conditions govern all equipment rentals, bookings and payments made through Gearzilla.ee.

Gearzilla is operated by Caesart Creative OÜ, registry code 16377416, with its registered address at Veerenni 29a, 10130 Tallinn, Estonia.

By placing and paying for a booking, collecting equipment or otherwise entering into a rental agreement with Gearzilla, the customer confirms that they have read, understood and accepted these Terms and Conditions, together with our Refund and Cancellation Policy and Privacy Policy.

1. Company information

Caesart Creative OÜ
Trading name: Gearzilla
Registry code: 16377416
Address: Veerenni 29a, 10130 Tallinn, Estonia
Email: info@gearzilla.ee
Website: https://gearzilla.ee

2. Eligibility to rent

The customer must be at least 18 years old and legally capable of entering into a contract.

Gearzilla may request:

  • Valid photographic identification;
  • Contact and billing information;
  • Company information;
  • A security deposit;
  • Proof of address; or
  • Other information reasonably necessary to verify the customer and assess the rental.

A person booking on behalf of a company confirms that they are authorised to enter into the rental agreement on that company’s behalf.

Gearzilla reserves the right to decline or cancel a rental where the required verification cannot be completed or where there are reasonable concerns regarding fraud, security or misuse of the equipment.

3. Bookings

A booking is confirmed only after Gearzilla has accepted it and any required payment or security deposit has been received or authorised.

Equipment shown on the website is subject to availability. Adding equipment to a cart, submitting a request or receiving an automated email does not by itself guarantee availability.

The confirmed booking specifies:

  • The rented equipment;
  • The rental period;
  • The rental price;
  • Collection and return arrangements;
  • Any security deposit; and
  • Any additional agreed services or charges.

The customer must check the booking confirmation and notify Gearzilla promptly of any errors.

4. Prices and payment

Unless stated otherwise, prices are shown in euros and include applicable taxes where legally required.

The customer must pay the rental price and any required deposit by the deadline shown during checkout, on the invoice or in the booking confirmation.

Gearzilla may withhold the equipment until all required payments, documents and verification have been completed.

The customer is responsible for any additional charges arising under the rental agreement, including charges for:

  • Late return;
  • Missing items;
  • Damage;
  • Cleaning beyond normal use;
  • Replacement or repair;
  • Delivery or collection;
  • Consumable items; and
  • Other agreed services.

5. Security deposit and payment authorisation

Gearzilla may require a refundable security deposit or payment-card authorisation before releasing the equipment.

The security deposit does not limit the customer’s liability. If the customer’s liability exceeds the deposit, the customer remains responsible for the outstanding amount.

After the equipment is returned, Gearzilla will inspect it for damage, missing items, excessive cleaning requirements and late return. If no outstanding charges exist, the deposit or payment authorisation will be released without unreasonable delay.

Gearzilla may deduct documented amounts owed under the rental agreement from the security deposit where legally permitted. The customer remains responsible for any amount exceeding the deposit.

Bank and payment-provider processing times are outside Gearzilla’s control.

6. Collection and inspection

The customer must collect the equipment at the agreed time and location unless delivery has been arranged.

The customer must inspect and, where practical, test the equipment at collection. Any visible damage, missing accessories or apparent technical problems must be reported before leaving the collection location.

A handover record, equipment list, photographs or other condition records may be used to document the condition and contents of the rental.

If another person collects the equipment for the customer, the customer remains fully responsible for the equipment and that person’s actions.

7. Rental period

The rental period begins and ends at the times stated in the booking confirmation.

Late collection does not extend the rental period or reduce the rental price.

The customer must return all equipment by the agreed return time unless Gearzilla has approved an extension in writing.

An extension is valid only after Gearzilla confirms it. Additional rental charges may apply.

8. Use and care of equipment

The customer must:

  • Use the equipment carefully, safely and only for its intended purpose;
  • Follow manufacturer instructions and any directions provided by Gearzilla;
  • Ensure that the equipment is used by competent persons;
  • Protect the equipment from theft, loss, impact, water, moisture, sand, smoke, extreme temperatures and other avoidable risks;
  • Keep the equipment under appropriate supervision and in a secure location;
  • Use suitable cases and protective equipment during transport;
  • Stop using equipment immediately if continued use could cause injury or further damage; and
  • Notify Gearzilla promptly of any fault, accident, loss or theft.

The customer must not, without Gearzilla’s prior written permission:

  • Sub-rent, lend, sell, pledge or transfer the equipment;
  • Remove or alter serial numbers, labels or identifying marks;
  • Open, dismantle, repair or modify the equipment;
  • Allow an unauthorised repair;
  • Use the equipment unlawfully or in an unsafe environment; or
  • Take the equipment outside Estonia.

The customer is responsible for checking that the equipment is suitable and compatible with their intended production, accessories and workflow.

9. Customer responsibility

The customer is responsible for the equipment from the moment it is handed over or delivered until Gearzilla confirms its return.

The customer remains responsible where the equipment is used, transported or held by an employee, contractor, crew member or other third party acting with the customer’s permission.

The customer is responsible for loss or damage occurring during the rental period, except for:

  • Normal wear and tear;
  • A pre-existing condition recorded at handover; or
  • A fault caused solely by an inherent defect and not aggravated by the customer’s continued use.

10. Damage, loss and theft

The customer must notify Gearzilla immediately if equipment is damaged, lost or stolen.

In the event of theft or suspected criminal activity, the customer must also notify the police promptly and provide Gearzilla with the police report or reference number.

The customer may be charged reasonable and documented costs arising from the incident, including:

  • Inspection and diagnosis;
  • Parts and repair;
  • Professional cleaning;
  • Replacement of equipment that is lost, stolen or beyond economical repair;
  • Replacement of missing accessories;
  • Transport and recovery; and
  • Reasonable loss of rental income while the equipment is unavailable.

Replacement charges will take account of the equipment’s type, condition, age, market value and reasonable replacement availability.

The customer must not arrange repairs without Gearzilla’s prior written approval.

11. Equipment failure

The customer must report any malfunction as soon as reasonably possible and stop using the equipment where continued use may be unsafe or cause further damage.

Gearzilla will, where reasonably possible, attempt to provide technical assistance, replacement equipment, alternative rental dates or an appropriate refund.

Gearzilla is not responsible for a fault caused by:

  • Incorrect or negligent use;
  • Accidental damage;
  • Incompatible third-party equipment;
  • Unauthorised repair or modification;
  • Failure to follow instructions; or
  • External circumstances outside Gearzilla’s reasonable control.

The remedies available for equipment problems are described in the Refund and Cancellation Policy. Mandatory consumer rights remain unaffected.

12. Late return

Equipment returned after the agreed return time may be charged at the applicable additional rental rate.

The customer may also be responsible for reasonable losses caused by the delay, including costs arising from a confirmed subsequent booking, to the extent permitted by law.

Failure to return the equipment and failure to respond to Gearzilla may be treated as unauthorised possession and reported to the relevant authorities.

13. Early return and unused equipment

Returning equipment before the end of the agreed rental period does not automatically reduce the rental price.

No refund is due merely because the customer did not use the collected equipment or used only part of a package.

14. Cancellation and refunds

Booking cancellations, changes and refunds are governed by Gearzilla’s Refund and Cancellation Policy, available on the website.

That policy forms part of the rental agreement.

Nothing in these Terms limits a consumer’s mandatory right of withdrawal or other rights under Estonian or European Union law.

15. Data and recording media

The customer is responsible for backing up and removing all data and recording media before returning the equipment.

Gearzilla is not responsible for lost, damaged, corrupted or disclosed recordings, files or other data, except where liability cannot legally be excluded.

Gearzilla may erase data remaining on returned equipment or media without notice. The customer must not return equipment containing personal, confidential or unlawful material.

16. Insurance

Unless explicitly confirmed in writing, the rental price does not include insurance covering the customer’s liability for loss, theft or damage.

Gearzilla may require evidence of suitable insurance for higher-value rentals or particular productions.

The existence of insurance does not release the customer from their obligations under the rental agreement.

17. Limitation of liability

Gearzilla will provide the equipment with reasonable care and in the condition described at handover.

To the extent permitted by law, Gearzilla is not liable for indirect or consequential loss, including:

  • Loss of production time;
  • Loss of recordings or data;
  • Loss of revenue, profit or opportunity;
  • Costs of replacement crew, locations or services; or
  • Reputational loss.

For business customers, Gearzilla’s total liability arising from a booking will not exceed the amount paid for that booking, except where a different limitation is required by mandatory law.

Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, death or personal injury where such liability cannot legally be excluded, or any mandatory consumer right.

18. Force majeure

Neither party is responsible for delay or failure caused by circumstances outside their reasonable control, including natural disasters, fire, major power or network failures, government restrictions, war, civil disturbance or transport disruption.

The affected party must notify the other party as soon as reasonably possible.

If Gearzilla cannot fulfil the booking because of such circumstances, the parties will attempt to agree on replacement equipment, new dates, store credit or an appropriate refund.

19. Personal data

Gearzilla processes personal data for booking administration, identity verification, payment processing, fraud prevention, customer support and compliance with legal obligations.

Further information is provided in Gearzilla’s Privacy Policy.

20. Complaints and disputes

Complaints should be submitted to info@gearzilla.ee and should include the customer’s name, booking number, description of the issue and requested solution.

Gearzilla will respond to written consumer complaints within 15 days unless a different period is required by law.

If a consumer and Gearzilla cannot resolve a dispute, the consumer may submit an application to the Estonian Consumer Disputes Committee:

Consumer Protection and Technical Regulatory Authority
Endla 10A, 10122 Tallinn, Estonia
Website: https://ttja.ee/en/consumer-disputes-committee

The customer may also seek any other remedy available under applicable law.

21. Governing law

The rental agreement is governed by the laws of the Republic of Estonia.

Disputes that cannot be resolved by agreement will be handled by the competent court in Estonia, unless mandatory consumer law provides the customer with the right to bring proceedings elsewhere.

22. General provisions

The booking confirmation, these Terms and Conditions, the Refund and Cancellation Policy, the Privacy Policy and any signed handover documents together form the rental agreement.

If there is a conflict between them, individually agreed written booking terms take priority, followed by the booking confirmation, these Terms and Conditions and the other referenced policies.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Gearzilla may update these Terms from time to time. The version accepted when the booking was confirmed applies to that booking unless a change is required by law or agreed with the customer in writing.
